About these terms
Docusy is a document scanner application for iPhone, iPad and Mac (the “App”), operated by WhiteLake Pty Ltd (ACN 642 302 887) (“WhiteLake”, “we”, “us”). These terms and conditions (the “Terms”) govern your download, installation and use of the App. By downloading, installing or using the App, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree, please do not use the App.
Your use of the App is also subject to Apple’s Licensed Application End User Licence Agreement (EULA). Where these Terms conflict with Apple’s standard EULA for App Store apps, Apple’s EULA prevails to the extent of the inconsistency.
We may update these Terms from time to time. Changes take effect when posted on this page; the “last updated” date above shows the latest revision. Your continued use of the App after a change means you accept the updated Terms.
Using the App
Docusy is free to download and use. Core features — scanning, viewing and organising documents — are available without payment. Certain premium features are unlocked through an optional subscription (see “Subscriptions and payment” below).
The App requires no account, login or registration. Your documents are stored locally on your device. How we handle the limited information the App does collect is described in our Privacy Policy.
Subscriptions and payment
- Premium features are offered through an auto-renewing subscription purchased via Apple’s in-app purchase system.
- All payments are processed by Apple through your Apple ID, under Apple’s terms. WhiteLake does not collect or store your payment-card details. We use RevenueCat to manage subscriptions and verify entitlements.
- Payment is charged to your Apple ID at confirmation of purchase. A subscription renews automatically unless it is cancelled at least 24 hours before the end of the current period, and your Apple ID is charged for renewal within the 24 hours before the period ends.
- You can manage or cancel a subscription at any time in your Apple ID / App Store account settings. Cancelling stops future renewals; access continues until the end of the current paid period.
- Subscription prices and available plans may change. Any price change is handled in accordance with Apple’s standard subscription rules, which require your consent before a higher price takes effect.
Refunds
Because purchases are made through Apple, refund requests are handled by Apple in accordance with the Apple Media Services terms — please request refunds through Apple. Nothing in these Terms limits any rights you have under the Australian Consumer Law, including the consumer guarantees that cannot be excluded.
Your responsibilities
When using the App you agree to:
- use the App only for lawful purposes and in accordance with these Terms and any applicable laws;
- not use the App to scan, store or distribute material you do not have the right to use, or that is unlawful;
- not copy, modify, reverse-engineer, decompile or attempt to extract the source code of the App, except to the extent permitted by law;
- not use the App in any automated, abusive or disruptive way.
Intellectual property
The App is licensed to you, not sold. WhiteLake and its licensors own all rights, title and interest in the App — including its software, design, graphics, logos and trademarks — which are protected by copyright and other laws. Subject to these Terms, WhiteLake grants you a personal, non-exclusive, non-transferable, revocable licence to use the App on Apple devices you own or control, for your own personal or internal business use. You retain all rights to the documents and content you create with the App.
Privacy
We take your privacy seriously. The App processes your documents on your device and does not upload their contents to us or any third party — your documents leave your device only when you choose to share or export them yourself. Disclaimer
Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or other laws that cannot lawfully be excluded. Subject to those rights, the App is provided “as is” and “as available”, and to the extent permitted by law we make no other warranties about it — including that it will be uninterrupted, error-free, or fit for a particular purpose. You use the App at your own risk and are responsible for keeping your own backups of important documents.
Limitation of liability
To the extent permitted by law, and subject to the consumer guarantees referred to above, WhiteLake will not be liable for any indirect, incidental, special or consequential loss, loss of data, loss of profit, or loss of goodwill arising out of or in connection with your use of the App. Where our liability cannot be excluded but can be limited, our liability is limited, at our option, to re-supplying the App or paying the cost of having it re-supplied.
Termination
You may stop using the App and delete it from your device at any time. Subscriptions are managed and cancelled through your Apple ID as described above. We may modify, suspend or discontinue the App or any of its features at any time, and may cease to make the App available; existing installations will continue to work subject to ongoing compatibility with your device and operating system.
Governing law and jurisdiction
These Terms are governed by the laws of New South Wales, Australia. You and WhiteLake submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts that may hear appeals from them. If a dispute arises, we encourage you to contact us first at support@whitelake.com.au so we can try to resolve it.
General
If any part of these Terms is found to be invalid or unenforceable, that part is severed and the rest continue to apply. A failure to enforce any provision is not a waiver of it. Together with the Privacy Policy and Apple’s EULA, these Terms are the entire agreement between you and WhiteLake regarding the App.
